General Terms and Conditions (GTC) – Cleaning Service

1. Scope

These General Terms and Conditions apply to all contracts for cleaning services concluded between XLBOX Services GmbH, Berthold-Haupt-Straße 34, 01257 Dresden (hereinafter referred to as "XLBOX") and its customers.
Any differing terms and conditions of the customer shall only apply if they have been confirmed in writing by XLBOX.

2. Subject matter of the contract

XLBOX provides professional cleaning services for private and commercial properties. These include, in particular, routine cleaning, deep cleaning, post-construction cleaning, window cleaning, and special cleaning services by individual agreement.
The exact scope of services is defined in the respective offer or contract.

3. Offer and conclusion of contract

XLBOX's offers are non-binding. A contract is formed either through written confirmation from the customer or by XLBOX commencing the cleaning service.
Any verbal side agreements require written confirmation.

4. Prices and Payment Terms

All prices are in euros and exclude statutory VAT.
Unless otherwise agreed, invoices are payable within 14 days of the invoice date without deduction.
In case of late payment, XLBOX charges default interest in accordance with § 288 BGB as well as a reminder fee.

5. Cancellation and rescheduling

Individual orders can be cancelled free of charge up to 48 hours before the agreed date.
In the case of short-notice cancellations, XLBOX reserves the right to charge 50% of the agreed order value.
If the cleaning appointment is cancelled on the day of execution or if access to the property is not possible, the full amount is due.

6. Customer's duty to cooperate

The customer shall ensure that XLBOX has unimpeded access to the property and that the areas to be cleaned are accessible and free from hazards.
Valuables and sensitive materials must be secured or removed separately by the customer.
Electricity and water must be provided free of charge.

7. Liability

XLBOX is only liable for damages caused by intentional or grossly negligent acts.
No liability is accepted for damage to improperly treated surfaces or in the event of improper pretreatment by the customer.
Damage must be reported to XLBOX in writing no later than 24 hours after cleaning.

8. Cleaning agents and equipment

Unless otherwise agreed, XLBOX provides all cleaning agents and equipment. Upon customer request, cleaning can be carried out using provided products – however, XLBOX accepts no liability for their effectiveness or compatibility.

9. Data protection

The collection and processing of personal data takes place exclusively within the framework of the applicable data protection regulations and the privacy policy of XLBOX.

10. Final Provisions

German law applies. The place of jurisdiction is Dresden, provided the customer is a merchant or a legal entity under public law.
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates its intended economic purpose.
